These terms and conditions (the “Program Terms”) apply to your participation in the Nova Credit Inc. (“Nova Credit”) Referral and/or Affiliate Program (the “Program”). By participating in the Program, users (“Participants”) agree to use the Program as outlined herein, the terms provided in the Program signup page at the time of a Qualified Referral and consistent with any other terms we may apply to the Program. If you do not agree to these Terms in their entirety, then you cannot register and participate in the Program. Participants also cannot register where in so doing, they would violate any applicable law or regulations.
“Referrer”: a registered participant in the Program who is provided a Referral Link to send to users and a legal resident of the United States.
“Referred User”: a person who has not previously used Nova Credit and with whom the Referrer shares their Referral Link.
“Referral Link”: a personalized referral link, provided to you by Nova Credit.
“Referral Credit”: the credit or reward given to a Referrer or Referred User.
Receiving a Referral Link
Upon signing up for the Program and providing all necessary information required, Referrers will receive a unique Referral Link that allows Referrers to receive Referral Credit. The Program is intended for personal use and is not to be used by any entity or organization. Referrers must respect the spirit and intent of the Program by refraining from engaging in spamming or other problematic practices, including creating fake accounts, signing up multiple times or harassing potential referral sources.
Referral Credit will be awarded for “Qualified Referrals” that meet the following conditions:
The Referred User must use the Referral Link from a Referrer in good standing;
If a Referred User received multiple Referral Links, Nova Credit will provide the Referral Credit to the person whose Referral Link is used most recently before the completed referral;
The Referred User must use the Referral Link when applying for a U.S. card through a card issuer or provider that utilizes Nova Credit to obtain the Referred Users international credit history (a “Nova Partner”). In the event that the Referred User’s international credit history is retrieved by the Nova Partner, the Referrer will receive Referral Credit subject to the Program Terms;
The Referred User must be a Qualified Referral who meets the following conditions:
Moved to the United States in the preceding two (2) year period;
Has their foreign credit history accessed as part of the credit card application from a Supported Country.
Supported Countries are: (i) Australia; (ii) Canada; (iii) India; (iv) Mexico; and (v) the United Kingdom;
Completes the application with the Nova Credit Partner in a full, good faith and truthful manner;
Has not previously completed an application with a Nova Credit Partner for which Referral Credit has been granted;
In the event that all the conditions and Program Terms are met, the Referrer and Referred User will receive the applicable Referral Credit that is in place at the time that the Nova Credit international credit report is received by the Nova Credit Partner; and
Such other requirements and conditions that may be imposed by Nova Credit in its sole and absolute discretion from time to time.
Receipt of Referral Credit
Referral Credits may be received by a Referrer for up to fifty (50) Referred Users. Referral Credits are subject to verification and will generally be awarded within 60 days of verification. Nova Credit may withhold a Referral Credit if it reasonably believes additional verification is required. Nova Credit may also withhold or invalidate any potential credits it deems fraudulent, suspect, or in violation of these Program Terms. If Nova Credit, in its sole discretion, believes providing Referral Credit will impose liability on Nova Credit or any of its affiliates or partners it may withhold or invalidate Credits.
All Nova Credit decisions are final and binding, except where prohibited, including decisions as to whether a Qualified Referral or Referral Credit is valid, when and if to terminate the Program and whether to change the Program. Any changes to the Program will be included on the Program page or in the Program Terms.
For the avoidance of doubt, while these Terms may supplement any additional terms entered into between a party and Nova Credit, under no circumstances will a party receive duplicate or combined credit in connection with the same transaction.
Release from Liability
As a condition of entering the Program, and unless prohibited by law, Participants agree that under no circumstances will Participants be entitled to any awards for any losses or damages, and Participants hereby waive all rights to claim punitive, incidental, consequential and any other damages, and waives any and all rights to have damages multiplied or otherwise increased. A waiver of rights may not apply to you in your jurisdiction of residence. Additional rights may be available to you.
Suspension or Cancellation of Program
Nova Credit reserves the right to cancel or suspend the Program at any time, should it determine, in its sole discretion, that the accuracy, administration, security or fairness of this Program has been violated or compromised in any way.
Except where prohibited, disputes, claims and causes of action arising out of or related to this Program or any prize awarded shall be resolved under the laws of the United States, and except where prohibited, California law (without reference to its conflicts of laws principles), and participant agrees to submit any dispute to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.
Nova Credit may prohibit anyone from participating in the Program or receiving Referral Credit if Nova Credit determines such Participant is attempting to undermine the fairness, integrity or legitimate operation of the Program in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other individual (whether or not enrolled in the Program), or representatives of Nova Credit. Use of any automated system to participate is strictly prohibited and will result in disqualification. Nova Credit reserves the right to disqualify anyone, cancel Credits, disable or suspect an account, and contact legal authorities (including law enforcement), if it should discover a user is tampering with the entry or referral process or the operation of the Program or violating these Terms. Referrals generated by a script, macro or other automated means will be disqualified. If a solution cannot be found to restore the integrity of the Program, we reserve the right to cancel, change, or suspend the Program.
Reservation of Rights
We reserve the right to modify or amend at any time these Terms and the methods through which Referral Credit is earned. We reserve the right to disqualify any Participant at any time from participation in the Program if he/she does not comply with any of these Terms. Failure to enforce any term of these Terms shall not constitute a waiver of that provision.
THE CONTENT, INFORMATION, LINKS AND FUNCTIONALITY OF THIS WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” AND WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF NON INFRINGEMENT OF THIRD PARTY RIGHTS, TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND FREEDOM FROM COMPUTER VIRUS OR OTHER HARMFUL COMPONENTS. WITHOUT IN ANY WAY LIMITING THE PRIOR SENTENCE, WE DO NOT MAKE ANY REPRESENTATION OR WARRANTY THAT (I) THE CONTENT AND INFORMATION OF THIS WEBSITE IS ACCURATE, SECURE, COMPLETE OR OTHERWISE FREE FROM ERRORS AND OMISSIONS, OR (II) THE LINKS AND OTHER ASPECTS OF THE WEBSITE ARE FUNCTIONAL.
